In camera In a judge's chambers; in private. Negligence Failure to exercise the care that an ordinarily prudent person would exercise in the same circumstances. Appellant The party appealing a final decision or judgment. Material evidence Evidence that is relevant to the issues in a case. Default Occurs when a defendant fails to respond to the plaintiff's complaint within the time allowed, or fails to appear at the trial. The court may then enter a default judgment Appeal The bringing of a case to a higher court for review of a lower court's order or judgment. False pretenses Representation of some fact or circumstance which is not true and is calculated to mislead, whereby a person obtains another's money or goods Liability A legal responsibility, obligation, or debt.
